Registration cancelled and fine for builder who provided false information – David James Shaw

A former building practitioner who provided false or misleading information in his registration application has been fined $2,500 by the Building Services Board and has voluntarily cancelled his registration.

David James Shaw (BP102430, cancelled) was granted building practitioner registration in March 2017 after submitting an application that included information to support the criteria of having a Diploma of Building and Construction and at least seven years’ experience in carrying out or supervising building work.

An investigation by Building and Energy discovered that Mr Shaw had sought assistance with his application from a third party, which was providing fraudulent references and documents to assist students and clients in applying for registration.

In his application, Mr Shaw falsely claimed to have been a site supervisor for a registered building contractor when in fact he worked as a draftsman and did not have supervision responsibilities. He also added three years to the time he actually worked for the business and submitted a falsified reference from the company’s construction manager.

Mr Shaw signed a declaration that the information provided in his application was true and correct.

Building and Energy A/Executive Director Saj Abdoolakhan said it was inexcusable for building registration applicants to provide Building and Energy with false information.

“The registration requirements prescribed under the State’s building laws are designed to ensure that only suitably trained, qualified and experienced people carry out these roles, which involve a high level of responsibility,” he said.

“To obtain registration under false pretences undermines the system that is designed to maintain high standards in the building industry in Western Australia.”
